Terms & Conditions

1. Booking & Payment

All bookings with Rowie Hawley Photography require a $100 non-refundable booking deposit to secure the date and time.

The remaining balance is due 24 hours prior to the session via bank transfer, or cash on the day by prior arrangement.

Bookings are not confirmed until the deposit has been received. Failure to pay the remaining balance by the due date may result in cancellation of the booking with no refund of the deposit.

2. Cancellations & Rescheduling

• The booking deposit is non-refundable under all circumstances.

• Cancellations made within 48 hours of the scheduled session may result in the full session fee being charged.

• Requests to reschedule must be made at least 48 hours prior to the session and are subject to availability.

• If Rowie Hawley Photography must cancel due to illness, emergency, extreme weather, or circumstances beyond control, the client will be offered a full refund or credit toward a future session.

3. Location & Travel

• Sessions may take place at a photographer-approved location, studio (if applicable), or a location chosen by the client.

• Rowie Hawley Photography is happy to travel to the client’s chosen location.

• A travel fee of $0.70 per kilometre applies for all travel outside the photographer’s standard service area.

• Travel distance is calculated from the photographer’s base location to the session location and back.

• Any additional costs such as parking fees, entry fees, permits, or accommodation (if required) are the responsibility of the client.

• The photographer reserves the right to decline locations deemed unsafe, inaccessible, or unsuitable for photography.

4. Copyright & Ownership of Images

All images captured remain the exclusive copyright of Rowie Hawley Photography, in accordance with Australian Copyright Law.

RAW files and unedited images remain the property of the photographer and will not be provided under any circumstances.

5. Client Usage Licence

Clients receive a personal-use licence for delivered images.

This licence allows:

• Personal printing

• Sharing on social media (credit to Rowie Hawley Photography appreciated)

This licence does not allow:

• Editing, filtering, cropping, or altering images

• Commercial use

• Selling or supplying images to third parties

Written permission is required for any use beyond personal use.

6. Photographer Usage Rights

Rowie Hawley Photography reserves the right to use images for:

• Portfolio

• Website

• Social media

• Advertising and promotional material

Clients wishing to opt out of this usage must notify the photographer in writing prior to the session.

7. Image Delivery

• Image delivery timeframes will be advised at the time of booking.

• Delivery times may vary during peak seasons.

• No refunds will be issued due to dissatisfaction with personal appearance, expressions, styling, or subjective preferences.

8. Safety & Responsibility

Clients are responsible for:

• The behaviour and safety of all participants

• Supervising children at all times

• Securing permission for private or restricted locations

Rowie Hawley Photography is not liable for injury, loss, or damage incurred during the session, except where required by law.

9. Weather Policy

For outdoor sessions, weather decisions are at the photographer’s discretion.

Sessions may be postponed due to unsafe or unsuitable conditions. Deposits will be transferred to a new date — not refunded.

10. Equipment Failure & Limitation of Liability

In the unlikely event of equipment failure, data loss, or circumstances beyond the photographer’s control, liability is limited to a refund of monies paid.

Rowie Hawley Photography is not responsible for additional costs, losses, or compensation.

11. Creative Control

Rowie Hawley Photography retains full creative control over:

• Posing

• Lighting

• Composition

• Editing style

Client requests are welcome but final artistic decisions remain with the photographer.

12. Refusal of Service

Rowie Hawley Photography reserves the right to refuse or terminate services due to:

• Unsafe conditions

• Abusive, aggressive, or inappropriate behaviour

• Non-payment

No refunds will be issued in these circumstances.

ADDITIONAL TERMS BY SERVICE TYPE

Weddings

• Wedding booking deposits are non-refundable.

• Final payment is due 14 days prior to the wedding date unless otherwise agreed.

• Timelines provided by the couple are followed to the best of the photographer’s ability; however, Rowie Hawley Photography is not responsible for missed images due to delays, late arrivals, weather, venue restrictions, guest interference, or events beyond control.

• No specific images or moments are guaranteed.

• Guest cameras and mobile devices may affect image quality and coverage.

Events (Public & Private)

• Event coverage is based on time booked, not number of images delivered.

• The photographer is not responsible for limited coverage due to venue rules, restricted access, lighting conditions, or crowd behaviour.

• Images may be used for promotional purposes unless otherwise agreed in writing.

Personal Sessions (Portraits, Family, Maternity, etc.)

• Session durations are approximate.

• Children’s cooperation cannot be guaranteed.

• No refunds are provided due to behaviour, mood, or lack of participation.

Commercial Photography

• Commercial usage rights are not included unless clearly stated in writing.

• Usage licences are issued per project and may be limited by time, region, or platform.

• Additional licensing fees may apply.

• Images may not be reused, altered, or transferred beyond the agreed scope.
